1. Overview

This website is operated by Clearly Kitty ("we", "us", "our"), 6210 Wilshire Blvd Ste 200 PMB 858, Los Angeles, CA 90048. By visiting our site or buying from us, you agree to these Terms of Service and to the policies linked below. If you don't agree, please don't use the site.

2. Who can buy

You must be at least 18, or the age of majority where you live, or be using the site with a parent or guardian's permission. You agree to give us accurate information when you place an order.

3. Our product and how to use it

  • The Tree Halo is a set of clear plastic sheets with plastic spikes, laid flat on the floor around a Christmas-tree stand. Cats don't like to stand on it, which discourages climbing the tree from the floor.
  • It does not stop every cat. It does not stop a cat jumping into the tree from furniture, and it does not stop chewing of branches, tinsel or cords.
  • The spikes are uncomfortable to step on. Don't walk on it barefoot, and keep it away from small children.
  • It is not a toy. Watch your cat when you first put it down.

4. Product images and videos

We work hard to show our product accurately. Some photos and videos on our website and social media are illustrations or dramatized scenes created to show how the Tree Halo is used, and colors can look slightly different on different screens. The product you receive is the Tree Halo described on the product page.

5. Prices and availability

Prices are in US dollars and can change without notice. We may limit quantities, discontinue a product, or cancel an order if a price or description was listed in error, and we'll refund you in full if we do.

6. Orders and payment

Placing an order is an offer to buy. We may refuse or cancel an order, for example if we suspect fraud or can't verify payment, and any charge will be refunded. Payments are processed securely by our checkout provider; we don't store your full card details.

7. Shipping

We ship to the United States and worldwide, and shipping is free. International orders may be charged import duties or taxes by the destination country, which the buyer pays on delivery and which are refundable under our Refund Policy. Delivery times, the Christmas order-by date and what happens if a package is late or lost are explained in our Shipping Policy. Delivery dates are estimates, not guarantees, but if your order will be late we'll tell you and you can cancel for a full refund.

8. Refunds and the 30-day money-back guarantee

Every order is covered by our 30-day money-back guarantee, described in our Refund Policy. If anything in these terms conflicts with the Refund Policy, the Refund Policy applies.

9. Email and text messages

If you sign up for our emails or texts, you agree to receive marketing messages from Clearly Kitty at the email address or mobile number you gave us. Signing up is optional and is not a condition of purchase.

  • Program: Clearly Kitty messages. These are order updates, offers, holiday order-by reminders and cart reminders.
  • Frequency: message frequency varies.
  • Cost: message and data rates may apply to texts.
  • To stop texts: reply STOP to any text. You'll get one text confirming you've been unsubscribed, and no more after that.
  • To stop emails: click the unsubscribe link at the bottom of any marketing email.
  • For help: reply HELP to any text or email clearlykittyhelp@outlook.com.
  • Carriers are not liable for delayed or undelivered messages.
  • How we handle your email address and number is explained in our Privacy Policy.

10. Your comments and reviews

If you send us reviews, comments, photos or ideas, you allow us to use, share and display them in connection with our store and social media. Please don't post anything unlawful, misleading, offensive or that belongs to someone else. We may remove content at our discretion.

11. Prohibited uses

You agree not to use the site for anything unlawful; to interfere with its security or operation; to upload viruses or harmful code; to scrape or copy it in bulk; or to impersonate anyone.

12. Our content

The Clearly Kitty name, logo, text, images and videos on this site belong to us or our licensors. You may not copy or reuse them for commercial purposes without our written permission.

13. Third-party services

14. Disclaimer

Apart from the guarantee in our Refund Policy and any rights you have under law that can't be waived, the site and our products are provided "as is". We don't promise the site will always be available or error-free.

15. Limitation of liability

To the fullest extent the law allows, Clearly Kitty is not liable for indirect, incidental or consequential damages arising from your use of the site or our products, and our total liability for any claim is limited to the amount you paid for the order in question. Nothing in these terms limits liability that cannot be limited by law.

16. Indemnity

You agree to cover us for claims or costs caused by your breach of these terms or your misuse of the site or our products.

These terms are governed by the laws of the State of California, USA, and applicable US federal law.

We may update these terms from time to time. The version posted on this page, with its "last updated" date, is the one that applies to your order.
